Right of withdrawal
Pursuant to Article 52 of the Consumer Code, the Consumer Customer will have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within the terms and in the manner specified by the Consumer Code.
To exercise the right of withdrawal, the Customer must send to the Seller a written notice, no later than 14 days from the date of receipt of the Products expressing the desire to exercise the right of withdrawal for the goods purchased on the Site, pursuant to Article 52 of the Consumer Code.
Once the aforementioned notice of withdrawal has been received, the Seller, having verified compliance with the terms for availing of the right of withdrawal, will send, through its Customer Service, an email of "return opening" to the Customer, containing the procedure to be followed for the return of the products (see Return procedure, see infra7).
The Product being returned must be shippedal Seller (Customer's care) no later than 3 days after receipt from the communication of the return opening (for the date, the postmark or the date of delivery to a courier, if any, shall be used). Shipping costs related to the return of the Product shall be borne by the Customer. The shipment, until the certificate of receipt in the warehouse indicated by the Seller, is under the full responsibility of the Customer.
Upon receipt of the products, the Seller will provide a refund: if the products have been sent within the set timeframeand if the products are perfectly intact and in their original packaging.
In compliance with the above-mentioned procedure, the Seller will refund the Customer all amounts paid by the latter during the purchase within 15 working days of receipt of the goods sent by the Customer Consumer. Upon its arrival at the address indicated by the Seller, the Product will be examined to assess any damage or tampering not resulting from transport. If the original packaging and/or packing is damaged, the Seller will withhold from the refund due a percentage equal to the respective loss in value of the Product.
With special exceptions in view of the specific characteristics of the goods sold, the right of withdrawal applies only to the Product purchased in its entirety. It is not possible to exercise withdrawal only on one or more parts of the purchased Product, unless there has been a specific written agreement between the parties Seller and Customer. In the case of Orders that include more than one Product, it will be possible to exercise withdrawal with respect to one or more Products in the Order, specifying the description of the Products you intend to return in the notice of withdrawal. In these cases, the refund will be made in the manner indicated in the previous article.
Regardless of the correspondence between the recipient of the Products indicated in the order form and the person who made the payment of the sums due for their purchase, the refund of the sums will always be made by the Seller in favor of the person who made the payment (identified as the holder of the credit card used for the purchase or as the holder of the bank account from which the bank transfer used for the purchase was made). The Seller, also in accordance with the Consumer Code, reserves the right to withhold the refund until it has received the Products inrestitution or until the Customer has proved that he/she has sent back the Products.
The Right of Withdrawal shall be deemed to be properly exercised if the following conditions are also fully met:the email containing the request to avail of the right of withdrawal contains the order code; the products related to the order for which the right of withdrawal is exercised are sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept products from the same order, returned and shipped at different times.
Returns and Return Procedure
The return procedure is opened only following a request by the Customer to exercise the right of withdrawal or following a request to return a non-conforming product (defective, damaged, etc.). In any case, downstream of the request by the Customer, the Seller will verify the actual existence of the conditions necessary for the opening of a return procedure.
Following the opening of a return procedure, the Seller will send the Customer an email containing a description of how to return the product.
In case of return forexercise of the "right of withdrawal", according to regulations of the Consumer Code, the Customer Consumer will provide - at his own expense - to deliver by an express courier the product to an address specifically indicated by the Seller through the email activated with the return procedure referred to in the preceding point.
The returned package must mandatorily contain a copy of the Order Confirmation sent to the email address indicated by the Customer or of the waybill present on the package at the time of receipt. Under no circumstances will parcels be collected on consignment or freight collect.
Time and method of reimbursement
A refund procedure can refer to two different types of situations:refund of the total amount related to an order for which the right of withdrawal has been exercised; partial refund related to an order for which the unavailability of one or more products has occurred.
Regardless of the method of payment used by the Customer and except as indicated on the subject of withdrawal, the refund shall be activated by the Seller in the shortest time possible and in any case within thirty (30) days from the sending of the Order Confirmation (in the case of partial refund for the unavailability of one or more products) and of fourteen (14) working days from the receipt of the Notice of withdrawal (in the case of withdrawal) using where possible the same payment channel with which the order was placed.
